This Farizon New Energy Commercial Vehicle Group User Agreement (hereinafter referred to as ''this Agreement'') is an agreement between you (hereinafter referred to as ''you/the user'') and Zhejiang Farizon Zhitong Technology Co., Ltd. and/or its affiliated companies (hereinafter referred to as ''the company/we/Farizon New Energy Commercial Vehicle Group'') regarding your use of the official website/mobile application/WeChat mini program/H5 page and other network platforms provided by Farizon New Energy Commercial Vehicle Group (hereinafter collectively referred to as ''network platform'') and related services.
This Agreement constitutes a prerequisite for your use of the Farizon New Energy Commercial Vehicle Group network platform and related services. Please carefully read the terms of this Agreement before using any Farizon New Energy Commercial Vehicle Group network platform and related services. We kindly remind you that the terms in this Agreement that may have a significant effect on your rights and interests, especially the terms that exempt or limit our liability, restrict your rights, and govern dispute resolution and applicable law, have been highlighted in bold and/or underlined. Please pay attention to and read them thoroughly.
Please understand that the Farizon New Energy Commercial Vehicle Group network platform and related services are only accessible to individuals aged 18 years old and above after the update. If you are under 18 years old, please register and use the Farizon New Energy Commercial Vehicle Group network platform and related services with the knowledge and consent of your guardian.
This Agreement is a general service agreement for us to provide you with Farizon New Energy Commercial Vehicle Group network platform and related services. In the pages of the Farizon New Energy Commercial Vehicle Group network platform and related services, there may be specific rules for certain services/functions, including rules and processes that need to be separately presented to you due to ongoing updates and developments in the product development process. Any specific rules presented separately shall have the same effect as this Agreement. In case of conflict between specific rules and this Agreement, the specific rules shall prevail. For matters not mentioned in the specific rules, this Agreement shall prevail.
When you fill in the information as prompted on the registration page, read and agree to this Agreement, it means that you have fully read, understood, and accepted all the contents of this Agreement. During the process of reading this Agreement, if you do not agree to this Agreement or any of its terms and provisions, you should immediately stop the registration process and/or the use the Farizon New Energy Commercial Vehicle Group network platform or related services.
With the changes and updates of our products and services, as well as changes in relevant laws, regulations, and policies, we may modify this Agreement or its attachments as needed from time to time. We will publish the relevant modified content in advance on the network platform and pop up a window to request your confirmation. If this Agreement or its attachments are modified, your continued use of the network platform and related services provided by the company shall be deemed as your acknowledgment, understanding, and acceptance of the modified content. If you do not accept the modified or updated content, please immediately stop using the network platform or related services provided by the company.
If you have any doubts or inquiries on other related matters while reading this Agreement, you can contact us through the contact information specified in this Agreement, and we will respond to you promptly.
1.1 Account Registration
1.1.1 You understand and agree that in order to fully use the Farizon New Energy Commercial Vehicle Group network platform and related services, you can register an account on the Farizon New Energy Commercial Vehicle Group network platform by yourself as an adult over 18 years old. This account proves your registered user identity, and serves as a credential for using the Farizon New Energy Commercial Vehicle Group network platform and related services.
1.1.2 You understand and agree that you can set up an account using a legal mobile phone number and register by setting a secure password. You can also log in and use the Farizon New Energy Commercial Vehicle Group network platform and related services with a third-party account. We will create an account for you based on the third-party account you use.
1.1.3 You understand and agree that, in order to provide prompt and accurate services, improve user experience, and ensure user safety, the Farizon New Energy Commercial Vehicle Group network platform may require you to provide additional information, including identification, for certain functions and/or services, such as test-drive appointments, online messages, dealer joining, service provider joining, and transport capacity service provider joining. For details, please refer to the Farizon New Energy Commercial Vehicle Group Privacy Policy.
1.2 Account Management
1.2.1 In order to provide you with more personalized and high-quality services, it is recommended that you supplement and improve your personal information. If there are any changes to the aforementioned information, you should update it promptly. You shall not use false information, impersonate others, or use other people's mobile phone numbers for registration. If you violate the aforementioned provisions, we have the right to terminate all Farizon New Energy Commercial Vehicle Group network platforms or related services provided to you, and have the right to take measures such as issuing warnings, restricting or prohibiting the use of some or all functions of the Farizon New Energy Commercial Vehicle Group network platform, banning the account, and deleting account-related information. You shall be responsible for any loss caused by your failure to provide true or timely updated information, and we shall not be liable for this.
1.2.2 You understand and agree that when you register with a specific mobile phone number, you can only register one account. When you apply for registration and subsequently use the Farizon New Energy Commercial Vehicle Group network platform, the nickname and signature you submit must not contain any content that is illegal, violates social morality, or infringes upon the rights and interests of others. We have the right to examine the legality of the registration information you submit, and if the aforementioned circumstances do exist, we have the right to refuse registration. For those who have already registered an account or if the registration information you submitted contains the aforementioned illegal or inappropriate information, we have the right to take measures unilaterally such as issuing warnings, requiring correction within a specified period, imposing temporary or permanent account suspension without prior notice. You shall bear all responsibilities resulting from this.
1.2.3 You understand and agree that you will not maliciously register a Farizon New Energy Commercial Vehicle Group network platform account (including but not limited to using invalid mobile phone numbers or using other people's mobile phone numbers) or use a Farizon New Energy Commercial Vehicle Group network platform account for illegal activities, disruption, harassment, deceiving other users, or any other behavior that violates the laws and regulations or this Agreement. We have the right to take measures such as issuing warnings, requiring correction within a specified period, imposing temporary or permanent account suspension without prior notice for accounts that engage in the aforementioned behaviors. You shall bear all responsibilities resulting from this. We have the right to use technical means (including collecting device information) to judge and eliminate malicious registration in order to protect the legitimate rights and interests of Farizon Auto and other Farizon New Energy Commercial Vehicle Group users. At the same time, we have the right to transfer the above actions to the judicial department for handling.
1.2.4 You understand and agree that the ownership of the Farizon New Energy Commercial Vehicle Group network platform account belongs to the Farizon New Energy Commercial Vehicle Group, and you only have limited rights to use the Farizon New Energy Commercial Vehicle Group network platform account. You are responsible for all activities that occur under your account, whether performed by yourself or authorized third parties. You should properly safeguard your Farizon New Energy Commercial Vehicle Group network platform account and should not give, transfer, lend, rent, sell, or share your account with others. You should not disclose any information related to your account and password to third parties or engage in any transaction involving them. You shall bear all losses and consequences caused by the loss or disclosure of account information due to your failure to take confidential measures, improper implement of confidential measures, or other actions. We have the right to take actions unilaterally such as issuing warnings, requiring correction within a specified period, imposing temporary or permanent account suspension without prior notice. You shall bear all responsibilities resulting from this.
1.2.5 If you use the Farizon New Energy Commercial Vehicle Group network platform and related services, it means that you are willing to accept the relevant emails, text messages, and/or system messages about this service sent by us. This type of information is very important for your normal use of the Farizon New Energy Commercial Vehicle Group network platform and related services, and for receiving important reminders and notifications. We shall not be liable for any inconvenience caused to you as a result. If relevant laws require us to obtain your authorization before sending certain marketing information to you, we will obtain your corresponding authorization before sending it to you.
1.3 Account Protection
1.3.1 You must properly keep your registered account and use the account information (including but not limited to the account and password) correctly and securely. If you find that your account and/or password may be lost or leaked, illegally used by others, or used abnormally, you can contact us through the contact information specified in this Agreement. Otherwise, all actions taken under the account will be considered as your own, and you will be responsible for any losses caused by the loss or illegal use of the account. When notifying us, you should provide us with true and valid proof materials to prove your registered user identity. If you cannot provide valid materials, we may not be able to provide you with corresponding account security services. You bear the corresponding risks yourself.
1.3.2 In order to ensure the security of your account, we may periodically or irregularly verify your account in different ways, including but not limited to requiring input of verification codes, conducting SMS verification, etc. If you are unable to complete the verification or refuse to verify, we may reasonably suspect that your account has been in abnormal conditions or stolen, and may suspend the provision of services to you or take further measures. If you believe that you have evidence to prove that there are no abnormal conditions with your account, please contact us in a timely manner through the contact information specified in this Agreement. At the same time, you should provide your true and valid identity proof materials to prove your registered user identity. We will promptly assess and handle it to avoid affecting your normal use.
1.4 Account Cancellation
1.4.1 We provide the right for you to cancel your Farizon New Energy Commercial Vehicle Group network platform account. You can request to terminate/cancel your account. We may set certain cancellation conditions based on the characteristics of the relevant network platform or related services. You need to meet these conditions before you can cancel your account. Cancellation of your account may result in permanent loss of all data under your account, and you shall bear this risk. After the termination of this Agreement, except where there are clear legal provisions, Farizon New Energy Commercial Vehicle Group is not obligated to disclose any information in your account to you or any third party designated by you.
1.4.2 Please understand and agree that if you voluntarily cancel your account, the points (if any) on the Farizon New Energy Commercial Vehicle Group network platform will be deemed as automatically waived. Except for situations explicitly specified by laws and regulations, we will not refund the corresponding cash value or provide any other form of compensation.
During the period from applying for the cancellation of the Farizon New Energy Commercial Vehicle Group network platform account to the final successful cancellation, if there are disputes involving your Farizon New Energy Commercial Vehicle Group network platform account, including but not limited to complaints, reports, lawsuits, arbitration, investigations by state authorities, etc., we have the right to suspend or terminate your Farizon New Energy Commercial Vehicle Group network platform cancellation process without separately obtaining your consent.
1.4.3 We remind you that canceling your Farizon New Energy Commercial Vehicle Group network platform account does not mean that the related liabilities caused by your use of the account will be exempted or reduced by canceling the account.
2.1 User Rights
2.1.1 You can only use the Farizon New Energy Commercial Vehicle Group network platform and related services within the scope of this Agreement and our express authorization.
2.1.2 According to this Agreement, during your use of the Farizon New Energy Commercial Vehicle Group network platform and related services, you have the right to provide us with opinions and suggestions to help us better serve you.
2.1.4 According to the terms and rules of this Agreement, you can upload original or legally authorized (including authorized transfers) images, texts, audio and video content within the Farizon New Energy Commercial Vehicle Group network platform. We reserve the right to review the content you upload by ourselves or entrust qualified third parties to do so. If the content you upload is suspected of violating laws, regulations, or the provisions of this Agreement, we may, without notice, refuse your upload, directly block, delete relevant information, or take measures to ban your account. Permanently banned mobile phone numbers cannot be registered again. You shall bear all adverse consequences resulting from the aforementioned actions, and we shall not be liable for any losses caused by your own violation of laws and regulations. If your actions cause adverse consequences to us, you shall be responsible for eliminating the impact and compensating us for all losses suffered, including but not limited to property damage compensation, reputation damage compensation, attorney fees, transportation expenses, and other reasonable expenses incurred for safeguarding rights.
2.1.5 Please understand and be aware that if the content you upload exceeds a reasonable storage period or violates laws and regulations, we have the right to delete or anonymize the content you uploaded. If your actions have been influenced by these measures, we do not assume any legal liability. We kindly remind you that if the information you upload is particularly important to you, please back up the relevant content in a timely manner to avoid unnecessary losses.
2.2 User Obligations
2.2.1 When registering an account directly, you confirm that you have the capacity for civil conduct or legal and valid authorization corresponding to the service you are about to use to sign or perform this Agreement. If you do not have the capacity for civil conduct to act in accordance with your behavior mentioned above, you and your guardian shall bear the corresponding legal consequences in accordance with the law.
2.2.2 When registering, you shall provide true, accurate, and complete information in order for us to provide corresponding user services. You should only obtain and use our network platform and related services from our authorized official channels. If you download or use our services through unofficial channels, you shall be responsible for any losses incurred during the use of such unauthorized services.
2.2.3 You understand and agree that except for some services that can be used in offline mode, when accessing the Farizon New Energy Commercial Vehicle Group network platform and related services through the Internet, you shall bear the network communication and traffic fees incurred by your use of the Farizon New Energy Commercial Vehicle Group network platform and related services, and the above-mentioned fees will be directly charged to you by the network operator. You can make relevant settings for the use of network information through the corresponding device settings page.
2.2.4 After you have completed the registration process, it means that you have obtained the right to use the account. You can log in to our network platform at any time to check and manage your personal information under this account. You are responsible for properly safeguarding your account and password (including but not limited to third-party accounts, passwords, dynamic passwords, verification codes, etc.) Unless you notify us in advance that your account or password has been leaked, any actions or implementations carried out through your account and password will be deemed as your own actions, and you shall bear the corresponding responsibilities and consequences.
2.2.5 You understand and agree to comply with the terms and rules of this Agreement, and promptly check and comply with the various terms and rules published and/or updated from time to time in the Farizon New Energy Commercial Vehicle Group network platform.
2.2.6 You understand and agree that with the development of Farizon New Energy Commercial Vehicle Group network platforms and related services, some products and/or services may be paid services. You need to pay the corresponding fees according to the relevant terms or agreements. Please refer to the specific agreements or terms presented by the Farizon New Energy Commercial Vehicle Group network platform for you.
2.2.7 If you find any unauthorized use of your account or any other situation that may result in theft or loss of your account, please notify us immediately in writing and in a valid manner. We will attempt to process the request after verifying your identity with necessary measures. Hereby, you understand that we require a reasonable amount of time to take action on any of your requests, and the actions we take in response to your requests may not be able to prevent or stop the formation or expansion of harmful consequences. Except for the company's fault, we shall not be liable for any consequences (including but not limited to any losses incurred by you) arising from the above situations.
2.2.8 When using the Farizon New Energy Commercial Vehicle Group network platform and related services, you must comply with the relevant laws and regulations of the People's Republic of China and may not use the services we provide for any illegal or inappropriate activities.
2.2.9 If you violate laws, regulations, this Agreement, or any service agreement provisions during the use of the services under this Agreement, we reserve the right to revoke, restrict, freeze, or forcibly modify your account, nickname, avatar, and other personal information. You shall bear any losses caused by this on your own.
2.2.10 Please note that any information or content you publish or provide through your own account in the services we provide should be in accordance with laws and regulations, and if authorization is required, you should obtain the necessary permission in advance. If we receive complaints or reports related to the content you provide, we may, in necessary circumstances, provide necessary information, including your account, to the disputing party, relevant departments, or regulatory authorities, in accordance with the law, in order to resolve the dispute.
We authorize you to use the Farizon New Energy Commercial Vehicle Group network platform and related services for non-commercial purposes. This means that you can choose to download, install, use, stop using, or uninstall the Farizon New Energy Commercial Vehicle Group network platform on your own. However, if you want to engage in commercial use (including but not limited to: sales, copying, distribution, pre-installation, bundling, or use for other commercial activities), you must obtain our prior written authorization and permission.
III. Service Description
3.1 The services you can obtain depend on the vehicle model you purchase, the region you are in, the functions you choose to enable, and the permissions granted to your account. Some functions and services (especially those related to vehicle control and owner rights) are only provided to the vehicle owner. Before enabling these functions, you need to ensure that you are the vehicle owner and the registered account owner or entity authorized by the vehicle owner. Otherwise, you will not be able to activate or enjoy such functions and services.
3.3 Please note that when you use a specific service or function of the Farizon New Energy Commercial Vehicle Group network platform, there may be separate agreements, related business rules, etc. (hereinafter collectively referred to as ''separate agreements''). Please read and agree to the relevant separate agreements before using the service. Your use of the aforementioned specific service shall be deemed as your agreement to the relevant separate agreements. If there is any conflict between the terms of this Agreement and a separate agreement, the provisions of the separate agreement shall prevail.
3.4 Advertising
3.4.1 You understand and agree that we have the right to provide you with relevant products and services, as well as commercial advertisements or other commercial and non-commercial information related to products of affiliated companies or other cooperative partners, during the provision of the Farizon New Energy Commercial Vehicle Group network platform and related services. We provide the above advertisements in various ways, including but not limited to pushing them on any location or application of the Farizon New Energy Commercial Vehicle Group network platform.
3.4.2 We will fulfill the obligations of pushing advertisements in accordance with relevant laws and regulations, but you understand and agree that the authenticity and reliability of advertisements or information should be based on your own understanding. Except as expressly provided by law, you shall bear the responsibility for any actions taken or disputes arising from the influence of advertisements or information, and we shall not assume any legal liability.
3.5 Intellectual Property
3.5.1 Except for information materials clearly owned by partners or third parties, all intellectual property rights related to Farizon New Energy Commercial Vehicle Group, including but not limited to copyrights, trademarks, patents, trade secrets, and all information content related to services, including but not limited to programs, software, animations, texts, images, graphics, audio, video materials, individually or in combination, are owned by Farizon New Energy Commercial Vehicle Group and are protected by the Copyright Law, Trademark Law, Patent Law, Anti-Unfair Competition Law of the People's Republic of China, relevant international treaties, and other intellectual property laws and regulations.
3.5.2 Without the written consent of the company, the above information shall not be directly or indirectly published or disseminated in any media, copied or redistributed for the purpose of dissemination or publication, or used for any other commercial purposes. If users violate the above agreement, we will pursue legal responsibilities in accordance with the law.
3.5.3 Please note that the content you upload, create, or publish through the Farizon New Energy Commercial Vehicle Group network platform, including sound materials, videos, animations, images, articles, or any combination of the above materials, should be your original work or you have obtained the corresponding rights holder's authorization before publishing. If the above content has any rights defects, resulting in infringement, you will bear full responsibility. Farizon New Energy Commercial Vehicle Group may delete or block the information you posted in accordance with the law or this Agreement; you also need to compensate for the losses incurred by Farizon New Energy Commercial Vehicle Group, affiliated companies, or third-party companies as a result. At the same time, you agree to authorize us and affiliated companies to take measures including monitoring infringement, sending lawyer's letters/company letters, initiating litigation or arbitration, mediation, settlement, etc., in their own name or through professional institutions, against the infringement of the aforementioned content (including derivative works), and initiate independent rights protection, seek full compensation or indemnity separately.
3.5.4 We respect the intellectual property rights and legitimate rights and interests of others, and we urge you to do the same. If you believe that your intellectual property rights or other legitimate rights and interests have been infringed, please contact us promptly and provide relevant ownership proof.
3.5.5 You understand and agree that, after agreeing to this Agreement, the rights mentioned above are not exclusive to you personally and can be transferred in accordance with laws and regulations, such as the property rights part of copyright (including but not limited to: reproduction right, distribution right, rental right, exhibition right, performance right, screening right, broadcasting right, information network transmission right, filming right, adaptation right, translation right, compilation right, and other transferable rights that should be enjoyed by the copyright owner). You agree to authorize us and our affiliated companies. You may sign separate agreements with us or our affiliated companies, and the specific terms shall be subject to the relevant agreements. Based on this, we and our affiliated companies can use the above content for commercial or non-commercial purposes, including modification, copying, adaptation, translation, compilation, or creation, thereby forming derivative products with intellectual property rights belonging to Farizon New Energy Commercial Vehicle Group or our affiliated companies. These derivative products can be used on websites, electronic magazines, magazines, publications, posters, public account articles, Farizon New Energy Commercial Vehicle Group network platforms, or other media channels; if necessary, we will also independently re-authorize third parties based on the actual situation.
We attach great importance to the protection of your personal information. In order to provide you with relevant services or functions, we will collect and use your personal information related to you or your vehicle reasonably according to different business functions and scenarios. We will process your personal information based on different legal bases. If we process your personal information based on your consent, we will process your personal information after obtaining your consent. 5.1 We are always willing to provide you with high-quality and reliable security services, but we cannot guarantee that all or any part of the services will operate or be used normally at any time. Due to certain circumstances that may lack the necessary environment and conditions to provide such services, the efficiency and quality of these services may be reduced or temporarily suspended. Unless otherwise specified by law, we do not assume any liability for compensation. This includes, but is not limited to:
In order to improve product functionality, enhance user experience, and ensure the security of products and/or services, we may periodically or irregularly update them; wireless communication networks may be unavailable or restricted; system paralysis may occur due to hacker attacks or virus invasions; technical adjustments or policy changes by the telecommunications department; temporary closure of the Internet due to government regulations; user's own reasons or reasons from third-party service providers;
floods, fires, droughts, typhoons, earthquakes or other natural disasters, large-scale epidemics, strikes (excluding company employee strikes), riots, civil unrest, and wars (regardless of whether they have been declared), government actions, sudden changes in national policies, and other force majeure events that result in product and/or service interruptions, data loss, account loss, account data destruction, and other losses or risks;
For the security, stability, and consistency of Farizon New Energy Commercial Vehicle Group network platforms and related services and products downloaded or obtained from unofficial channels;
The situation where the Farizon New Energy Commercial Vehicle Group network platform software is incompatible with other software or hardware systems, resulting in the inability to operate normally.
5.2 You understand and agree that the services, products, and information of the Farizon New Energy Commercial Vehicle Group are provided only in their current state. To the maximum extent permitted by applicable law, we expressly refuse to provide any express or implied warranties or guarantees for the ''services'', ''information'', or ''products'', including but not limited to warranties or guarantees for commercial use, suitability for specific purposes, or non-infringement of others' rights. To the extent permitted by law, we shall not be liable for any personal injury or indirect, punitive, special, or consequential damages arising from or in connection with the services under this Agreement (including loss of business, loss of revenue, loss of profits, loss of use of data, or other economic loss), except as otherwise provided by law.
5.3 At the same time, given the special nature of network services, in order to ensure the security and consistency of services, you agree that we have the right to modify, interrupt, or terminate certain services without prior notice. At the same time, we reserve the right to unilaterally change, suspend, restrict, terminate, or revoke all or part of the services under this Agreement at any time without any notice, due to business development needs.
5.4 By authorizing your account or any other means, you will bear all the risks and consequences caused by others who are not the account owner using your account or device.
5.6 Please understand and agree that for the convenience of users, our products and/or services may contain links to third-party services and products. If you click on a third-party link and use the services/products provided by the third party to obtain or use third-party products and their related services, it is deemed that you accept the third-party services and products. The responsibilities, obligations, or debts arising from you and the third-party products and their related services shall be handled in accordance with relevant laws and regulations. We recommend that you carefully read their agreement terms and any other applicable policies or terms, including applicable personal information protection policies, before using third-party products and their related services. For third-party products and related services, you acknowledge that any terms regarding the use or licensing of such products and services are only binding between you and the third party, and have no legal effect between you and us.
5.7 You should properly safeguard your account and password (if used), strengthen password security, and regularly change passwords to prevent account leakage or theft. We shall not be liable for any losses suffered by users due to the leakage or theft of user accounts not caused by us, such as the loss or reduction of accounts and user rights within the accounts.
6.1 If we discover or receive reports or complaints from others about your violation of the provisions of this Agreement or any malicious behavior, we have the right to delete or block the relevant content at any time without notice, and impose penalties on the illegal account, including but not limited to warnings, restrictions or prohibitions on the use of some or all functions, account suspension, cancellation, etc. We will announce the handling results and reserve the right to hold you liable.
6.2 We have the right to take appropriate legal actions based on reasonable judgment against behaviors that violate relevant laws, regulations, or provisions of this Agreement, and report relevant information to relevant departments in accordance with laws and regulations. You shall bear all legal liabilities arising therefrom on your own.
6.3 You understand and agree that you shall be solely responsible for any claims, demands, or losses asserted by any third party resulting from or arising out of your violation of this Agreement or relevant service terms; and you shall also compensate us for any losses suffered as a result.
6.4 Unless otherwise expressly stated in writing, we do not make any form of express or implied statements or warranties (except as otherwise provided by the laws of the People's Republic of China) regarding the operation of this website and the information, content, materials, products (including software) or services contained on this website.
VII. Amendment and Termination of the Agreement
7.1 We have the right to change or terminate part or all of the Farizon New Energy Commercial Vehicle Group network platform and related services within the scope permitted by laws and regulations based on business development or other reasonable reasons, or change, delete, or transfer the content you store or publish in the Farizon New Energy Commercial Vehicle Group network platform and related services. We will inform you in advance, and you should timely migrate and store data as needed. When we terminate the provision of the Farizon New Energy Commercial Vehicle Group network platform and related services, you can contact us through the contact information specified in this Agreement to handle related matters.
7.2 We have the right to change or terminate your account or the permission to use the Farizon New Energy Commercial Vehicle Group network platform and related services based on legitimate reasons, or to change, delete, or transfer the content you store or upload on the Farizon New Energy Commercial Vehicle Group network platform and related services.
7.3 Please understand and agree that after we terminate the provision of Farizon New Energy Commercial Vehicle Group network platform and related services to you, except as otherwise provided by law, you will not be able to log in or access account information. We will stop collecting and using your personal information, and the personal information already collected will be deleted. Other existing data will continue to be stored by us after being anonymized. Terminating the provision of the Farizon New Energy Commercial Vehicle Group network platform and related services to you does not affect the effectiveness of any breach or any other form of liability that you may have towards us or any third party prior to the termination of the service.
VIII. Notice
Under the terms and rules of this Agreement, we may provide all notifications to you through Farizon New Energy Commercial Vehicle Group network platform announcements, internal messages, emails, text messages, or regular mails. The date of sending such notifications shall be deemed as the date of delivery to you.
9.1 The establishment, effectiveness, performance, interpretation, and resolution of disputes of this Agreement shall be governed by the laws of the People's Republic of China mainland (for the sole purpose of this Agreement, excluding the laws of the Hong Kong Special Administrative Region, Macao Special Administrative Region, and Taiwan region).
9.2 Any disputes arising from or related to this Agreement shall be resolved through friendly negotiation between the parties in the first place. If the parties fail to resolve such disputes through negotiation, either party shall have the right to bring a lawsuit to the people's court with jurisdiction over Zhejiang Farizon Zhitong Technology Co., Ltd. In the event of a conflict between a specific clause and the jurisdictional provisions of this Agreement, the specific clause shall prevail within the scope of its application.
